Terms of Use
These Terms of Use (“Terms”) govern your access to and use of the Kigitz website, dashboards, AI-assisted features (including “Kigi”), and related services (collectively, the “Platform”) operated by Kigitz (“we,” “our,” or “us”).
By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Platform Purpose
The Platform is provided for internal finance operations support, bookkeeping workflows, reporting visibility, analytics, automation, and informational tools. Kigitz is not a licensed CPA firm.
2. No Professional Advice
The Platform does not provide audit, assurance, tax preparation, tax filing, legal advice, or investment advice. All outputs are provided for internal informational purposes only.
3. AI-Assisted Features Disclaimer
The Platform may include AI-assisted tools that generate summaries, insights, or workflow support based on available data. AI outputs may be inaccurate, incomplete, or outdated and must not be relied upon for compliance, tax filings, or external reporting.
4. Internal Use Only; No External Reliance
All dashboards, reports, forecasts, and AI outputs are unaudited and intended solely for internal management purposes. They are not financial statements prepared under GAAP and are not intended for reliance by investors, lenders, regulators, or third parties.
5. User Responsibilities
You are responsible for ensuring that information you provide is accurate and complete. Kigitz is not responsible for errors arising from missing, delayed, or inaccurate client-provided data.
6. Third-Party Tools and Subprocessors
Kigitz may use third-party providers to support hosting, communications, analytics, automation, and AI functionality (e.g., Google Workspace, Twilio/WhatsApp, Coefficient, AI model providers such as Anthropic Claude). These providers process data only to provide services on Kigitz’s behalf.
7. Acceptable Use
You agree not to:
- Use the Platform for unlawful purposes
- Attempt unauthorized access
- Interfere with security or functionality
- Scrape, reverse engineer, or misuse AI outputs
- Upload malicious code or abusive content
8. Suspension and Termination
We may suspend or terminate access to the Platform at any time for security, misuse, or breach of these Terms.
9. Intellectual Property
All Platform content, branding, software, dashboards, and AI workflows are the property of Kigitz or its licensors. You may not copy, reproduce, or distribute without written consent.
10. Limitation of Liability
To the fullest extent permitted by law, Kigitz’s total liability arising from or related to the Platform shall not exceed the fees paid by you to Kigitz in the three (3) months preceding the event giving rise to the claim. Kigitz shall not be liable for indirect or consequential damages.
11. Privacy
Your use of the Platform is governed by our Privacy Policy, which is incorporated by reference.
12. Modifications
We may update these Terms from time to time. Continued use constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of Ontario, Canada.
